The attorneys of Stark & Stark’s Mass Tort team work tirelessly on behalf of their clients to obtain the maximum compensation for their injuries. The Mass Tort group prosecutes individual claims for personal injury which arise out of a common set of facts or circumstances, such as the use of a defective drug or a catastrophic event which causes common injuries.

Mass tort claims typically consist of assertions that a company intentionally, knowingly, and negligently produced and distributed a defective product, which, in turn, led to the injuries suffered by the claimants. In the Fall of 2011, the Stark & Stark Mass Tort team launched the Mass Tort Law Blog, a blog dedicated solely to providing information relating to personal injury claims that have been designated as a Mass Tort, such as defective drugs, environmental contamination and defective medical devices.

Mass torts commonly include cases related to pharmaceutical products, medical devices, environmental hazards and catastrophic events.

Pharmaceutical Products – Our Mass Tort team pursues claims against drug manufacturers so they can be held liable when the drugs they market are proven to be defective and cause catastrophic injury to the people who use them. Our attorneys protect the rights of those injured and strive to obtain the maximum compensation possible for them and their families. Stark & Stark’s Mass Tort group is committed to assisting clients injured through the negligent and sometimes intentional acts of producing, marketing and distributing defective pharmaceutical drugs. Our Mass Tort team is currently involved in or investigating cases related to Fosamax®, Actonel®, Aredia®, Zometa®, Hydroxycut®, YAZ®/Yasmin®, Actos®, Crestor® and Darvocet®/Darvon®.

Medical Devices – Stark & Stark’s Mass Tort team regularly files claims against the manufacturers, distributors, suppliers and retailers of defective medical devices. Our attorneys hold the manufacturers of defective medical devices accountable for injuries suffered as a result of their negligence. These cases can include a defect in the design or manufacturing of the product, or a failure to warn the public of possible defects after the product has been produced and distributed. Our Mass Tort team is currently involved in or investigating cases related to Nuvaring®.

DePuy ASR Hip Replacement Recall
DePuy Orthopedic, Inc., a subdivision of Johnson & Johnson, manufactured the ASR XL Acetabular System: a metal-on-metal design which has found to cause serious pain and injuries in patients who received the hip replacement. The problem with the design is that it uses the metal-on-metal design, in contrast to the long used ceramic ball and cup. There is inadequate clearance between the metal ball and the metal cup which creates a greater chance of the components locking together and creates high levels of friction. Patients who received the hip replacement have suffered from misalignment; difficulty standing and walking; crunching or popping noises; limping or favoring one leg; hip fractures or dislocation; fatigue; tissue inflammation with infection or necrosis; and severe hip pain.

Environmental Hazards & Toxic Torts
– Stark & Stark’s Mass Tort team represents clients in cases where injuries have occurred due to environmental hazards. Our attorneys are well-versed in the ever-changing state and federal regulations designed to prevent these injuries from occurring. Our attorneys are experienced in litigation arising from injuries suffered due to negligence related to asbestos, benzene, chemical exposures, lead poisoning, mold and chemical contamination.
